Condominiums and Subdivisions
Reuben & Junius works with condominium and subdivision developers from the project’s start to finish. This work includes, assisting with project planning, consultant hiring, subdivision mapping strategy, obtaining the public report from the California Department of Real Estate, and the sale of units.
These projects require exceptional organization. Poor planning or a late start may significantly delay the sale of units. It is crucial that the developer process the necessary subdivision map approvals and condominium documents in parallel with entitlements or project construction. This is especially important in San Francisco, where it can take a year or longer to obtain subdivision map approval. Our attorneys help clients navigate complicated local procedures for obtaining the final subdivision map and prepare the required condominium documents. Our documents have been pre-approved by the California Department of Real Estate.
We provide advice on condominium conversions, including the complex and often confusing San Francisco condominium lottery process. We help clients solve problems with the operation of homeowners associations and provide advice on compliance with related state laws.
Our residential condominium work has included the following San Francisco projects:
• A 233-unit, mixed-use project in the South of Market area, near AT&T Park
• A 269-unit project in the Mission Bay area
• A 128-unit project in Hayes Valley
• A 43-unit project in the Financial District
• Scores of smaller residential projects throughout the city
Reuben & Junius also has experience with commercial condominiums, which are increasingly common in California. Our attorneys have assisted with converting office buildings to commercial condominiums as well as with planning and documentation of new commercial subdivisions.
These new projects have included both “vertical” condominium subdivisions and parcelization of a large development lot. For example, the firm advised the developer of a 538-acre mixed-use business park in Tracy, California, and prepared the master CC&Rs for the project. Other projects include the subdivision of commercial/retail parcels in an integrated planned-unit development project and the drafting of a reciprocal easement agreement necessary to govern parking, utilities, roadways and other shared facilities.
