Jay F. Drake has been practicing law since 2000. Mr. Drake's practice focuses on subdivision and condominium, transactional real estate, land use and zoning.

SUBDIVISION AND CONDOMINIUM LAW

Mr. Drake has extensive experience in all aspects of subdivision and condominium law. He has worked with clients on projects ranging from 2 unit condominium conversions to 350 unit multi-phase developments with large commercial components, including several large projects in San Francisco. Mr. Drake has overseen subdivision projects from start to finish, coordinating all aspects of the process, including working with civil engineers, DRE consultants and budget preparers, title companies, lenders, and all government and regulatory agencies.

Mr. Drake has successfully represented subdividers before the California Department of Real Estate (DRE) in obtaining their final subdivision public report. He has guided subdivision and condominium maps through the entire review and approval process, including interpreting the California Subdivision Map Act and local subdivision ordinances. Mr. Drake has drafted all condominium management documents, including the declaration of covenants, conditions and restrictions, homeowner's association bylaws, homeowner's association articles of incorporation; deeds, purchase agreements, and reciprocal easement agreements for large mixed use projects.

TRANSACTIONAL REAL ESTATE AND GENERAL BUSINESS

Mr. Drake has experience in business entity formation for both real estate and general business purposes, including limited liability companies, limited partnerships and corporations. Mr. Drake's transactional experience also includes purchase agreements, commercial leasing, title review and due diligence.

LAND USE, PLANNING AND ZONING

Mr. Drake has significant experience in San Francisco land use, planning and zoning practice. Mr. Drake works closely with San Francisco City and County regulatory agencies, including the Departments of City Planning, Building Inspection and Public Works. His clients range from individual homeowners to large-scale real estate developers requiring complex land use entitlements. Mr. Drake has experience with commercial, office and retail uses, but his particular expertise is with residential projects. Mr. Drake's experience also includes compliance with both state and local environmental and historical preservation regulations.
